Executive Summary
Portugal underwent a comprehensive overhaul of its alternative investment fund regulatory framework in 2023 with the enactment of Decree-Law 27/2023 (UCI Law) and CMVM Regulation 7/2023. The new Asset Management Regime consolidates previously fragmented legislation, implements EU AIFMD while reducing regulatory "gold-plating," and introduces streamlined authorization procedures.
The Portuguese alternative investment fund sector operates under a multi-layered regulatory framework centered on the UCI Law (Decree-Law 27/2023) as primary legislation. The CMVM (Comissão do Mercado de Valores Mobiliários) serves as the sole competent regulatory authority for authorization, supervision, and enforcement.
